These Terms of Service constitute a legally binding agreement between you and UrgentGo Courier (Pty) Ltd. Please read them carefully before using our services. By using our services, you acknowledge that you have read, understood, and agree to be bound by these terms under South African law.

1. Introduction and Acceptance

These Terms of Service ("Terms") govern your use of UrgentGo Courier (Pty) Ltd services ("Company", "we", "us", or "our"). By using our courier, logistics, or delivery services, you ("Customer", "you", or "your") agree to be bound by these Terms in accordance with South African law. Our services are provided subject to the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, and other applicable South African legislation. If you do not agree to these Terms, you may not use our services.

3. Service Description

UrgentGo Courier provides comprehensive logistics and delivery services including: • Same-day courier and delivery services • Express and standard courier services • Trucking and freight services • Airfreight solutions • Third-party logistics (3PL) services • First and final mile delivery • Fleet replacement services All services are subject to availability, geographic coverage, and operational capacity. Service levels and delivery times are estimates and not guarantees unless specifically agreed in writing.

4. Customer Obligations

By using our services, you agree to: • Provide accurate and complete information for all shipments • Ensure all items comply with our acceptable use policy • Package items appropriately to prevent damage during transport • Be available at specified pickup and delivery times or designate an authorized representative • Pay all charges and fees as agreed • Comply with all applicable laws and regulations • Not use our services for illegal or prohibited activities You warrant that you have the right to ship all items and that all information provided is accurate and complete.

5. Prohibited Items

The following items are strictly prohibited from shipment: • Cash, currency, or negotiable instruments • Firearms, ammunition, and weapons • Explosives, flammable materials, and hazardous substances • Live animals (except with prior written approval) • Illegal drugs and controlled substances • Tobacco products and cigarettes • Alcoholic beverages without proper licensing • Artwork and antiques (unless professionally packaged and declared) • Perishable goods without appropriate packaging • Items exceeding size and weight limitations • Seditious, treasonable, or offensive materials • Any items prohibited by South African law We reserve the right to refuse shipment of any item at our discretion.

6. Pricing and Payment Terms

Pricing is based on current rate schedules and may vary based on: • Distance and delivery zone • Package dimensions, weight, and value • Service type and delivery timeframe • Additional services requested • Fuel surcharges when applicable Payment terms: • Payment is due as agreed at time of booking • Corporate accounts: Net 30 days with approved credit application • Credit card payments processed securely through authorized processors • Cash on delivery available for eligible shipments • Late payment charges may apply as per the National Credit Act All prices include VAT where applicable. Additional charges may apply for failed deliveries, address corrections, or special handling.

7. Liability and Insurance

Our liability is limited as follows: • Maximum liability per shipment: R5,000 or declared value, whichever is lower • Liability limited to direct losses only • No liability for consequential, indirect, or special damages • No liability for delays beyond our reasonable control Insurance coverage: • Basic coverage included up to R1,000 per shipment • Additional insurance available for higher value items • Claims must be reported within 48 hours of delivery • All claims subject to investigation and proof of loss We are not liable for losses due to: • Acts of God, natural disasters, or force majeure events • Government actions, strikes, or civil unrest • Improper packaging or undeclared value • Failure to follow our shipping guidelines • Pre-existing damage not noted at pickup

8. Delivery Terms and Conditions

Delivery arrangements: • Delivery attempts made during standard business hours unless otherwise arranged • Signature required for all deliveries unless waived in writing • Delivery to reception, security, or authorized representative constitutes valid delivery • Three delivery attempts maximum before return to sender • Customer responsible for additional charges if delivery cannot be completed Risk of loss transfers to recipient upon delivery. We are not responsible for packages after successful delivery, even if delivered to an unauthorized person at the specified address. Time estimates are not guaranteed and depend on traffic, weather, and operational conditions.

9. Claims and Disputes

Claims procedure: • All claims must be submitted in writing within 30 days of shipment date • Include tracking number, proof of value, and evidence of loss or damage • We reserve the right to inspect damaged items before settlement • Claims processed within reasonable timeframe after complete documentation received Dispute resolution: • Initial disputes handled through our customer service department • Unresolved disputes subject to mediation in Johannesburg, South Africa • Final disputes resolved through South African courts • Consumer Protection Act rights preserved where applicable All legal proceedings must be instituted within one year of the incident giving rise to the claim.

10. Data Protection and Privacy

In accordance with the Protection of Personal Information Act (POPIA): • We collect only necessary personal information for service delivery • Information used solely for logistics, billing, and customer service purposes • Data shared with authorized agents and service providers only • Reasonable security measures implemented to protect personal information • You have rights to access, correct, and delete personal information We may use information for: • Service delivery and customer communication • Billing and payment processing • Service improvement and quality assurance • Marketing communications (with consent) • Legal compliance and regulatory reporting Your privacy rights are protected under South African law.

11. Force Majeure

We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including: • Natural disasters, extreme weather conditions • Government actions, regulations, or restrictions • Labor strikes, work stoppages, or industrial action • War, terrorism, or civil unrest • Public health emergencies or pandemics • Infrastructure failures or transportation disruptions During force majeure events, we will make reasonable efforts to minimize service disruption and communicate with affected customers.

12. Intellectual Property

All intellectual property rights in our services, website, systems, and materials remain our exclusive property. You may not: • Copy, modify, or distribute our proprietary materials • Use our trademarks, logos, or branding without written permission • Reverse engineer or attempt to access our systems unauthorized • Create derivative works based on our intellectual property You grant us limited rights to use your information for service delivery purposes.

13. Termination

These Terms remain in effect until terminated: • You may discontinue use of our services at any time • We may terminate service for breach of Terms with reasonable notice • Outstanding obligations survive termination • Accrued charges remain payable after termination We reserve the right to refuse service to any customer who violates these Terms or engages in abusive or fraudulent behavior.

14. Amendments and Updates

We may update these Terms from time to time: • Changes effective upon posting to our website • Continued use of services constitutes acceptance of updated Terms • Significant changes communicated via email or direct notification • Previous versions available upon request We encourage regular review of these Terms to stay informed of any changes.

15. Governing Law and Jurisdiction

These Terms are governed by South African law: • Subject to jurisdiction of South African courts • Johannesburg High Court has jurisdiction over disputes • Consumer Protection Act rights preserved where applicable • International conventions apply to cross-border shipments where relevant If any provision is found unenforceable, the remainder of these Terms remains in full force and effect.
